TERMS AND CONDITIONS

1. SERVICE AND MISSION

Gage & Company Ltd. d/b/a GageHome and as GageConcierge alleviates the stresses of Boulder homeownership by being a trusted partner for all of your home’s needs. We’re carpenters, entrepreneurs, and innovators dedicated to making home improvement and management effortless.  We offer a monthly services bundle which includes an initial evaluation covering the main 20-points of your property, and creation of a custom Property maintenance plan and profile, helpful reminders about upcoming maintenance and other projects which would be beneficial to the property, a weekly check-in regarding your property, including a status report, insider tips, ideas and recommendations curated for your property, and access to GageConcierge employees/contractors for small general handyman/handywoman type projects on the property at a competitive hourly rate.  

2. OUR POLICIES 

Our policies listed in these Terms of Service may be updated from time to time, as needed, in order to best serve our team members, clients, and best practices related to COVID-19. Prices of services may be subject to change. At all times, the Terms of Service listed here on the website are the most current and are the Terms of Service that govern.  Active clients will be given thirty (30) day written notice of any price increases. If you do not cancel your contract upon receipt of this notice, you will be deemed to have accepted the revised pricing. 

3. COVID-19 INFORMATION

We agree to adhere to CDC guidelines and Colorado Executive Orders regarding COVID-19, including: mask use in indoor public places for unvaccinated employees, 6 ft. distancing, and frequent hand washing. We will not dispatch employees to locations where client family is exhibiting symptoms of COVID-19, has been diagnosed with COVID-19, or has had known exposure within 10 days.  For everyone's health and safety, we take these precautions seriously. 

4. PLANS AND PAYMENT 

Clients will be presented with a flat-fee for basic concierge services for a specified property.  The monthly fee is billed in advance month-to-month.  Either party may cancel the agreement for any reason, but cancellations must be made before the 15th of the month to become effective on the following month.  Monthly concierge services include a certain number of hours of a GageConcierge employee.  Any hours spent by a GageConcierge employee above this included amount will be billed at an hourly rate of $75/hour (subject to revision), billed by the ½ hour. This includes time spent overseeing projects.

Clients will be billed for all materials purchased for any projects performed by a GageConcierge plus a 25% mark-up.

If GageConcierge oversees a larger project, we will charge an oversight fee equal to 25% of all project costs (whether related to labor, parts or licensing fees) up to the first $7500, and 15% of all project costs thereafter, as compensation for the oversight, coordination and communication services we provide in connection with the Project.  In addition, if a GageConcierge employee needs to be on-site to oversee the project, you will be billed in 30 minute increments.

5. SUBCONTRACTORS.  

For your convenience, GageConcierge will serve as a general contractor and coordinate all projects with sub-contractors.  At times we may request that you pay a deposit with respect to a project to be performed by a sub-contractor.  You agree that we may hold this project deposit in any account, comingled with any other funds, and we have no obligation to pay any interest on the deposit.  In the event that the sub-contractor performs work and invoices us, we will release a portion of the deposit to pay such amounts owed to the sub-contractor.  We may ask for additional deposits from time to time.  Any unused portion of a deposit will be released back to you (along with a statement explaining any deductions) within forty (40) days after we receive the final invoice from the sub-contractor.  

We will do our best to recommend high-quality sub-contractors for your Projects if you request us to do so, set the best expectations prior to work, and, while we don't warranty their work, we will pass along will pass along their warranties directly to you.  We can also work with sub-contractors who you have a previous relationship with if they are willing to sign our subcontractor agreement and are properly bonded and insured, such determination to be made in our discretion.

6. GUARANTEES AND LIMITATIONS.

We will do our best to recommend maintenance services based on our knowledge of your property.  Our knowledge will be limited to what can be determined by a visual inspection.  Our evaluation and recommendations are based off best practices; you understand that we are not in control of temperature swings and natural events that can cause premature damage to the Property.  We cannot detect, nor shall we be responsible for, latent defects or hidden issues not detectible upon reasonable inspection.  In addition to other latent issues, you agree to indemnify and hold us harmless for any issues or damages related to the presence of radon gas or mold on the property (unless the mold was caused directly by the negligent acts or omissions of us).

We will provide you with a warranty on all workmanship, materials and equipment furnished and/or incorporated by GageConcierge employees for a period of one (1) year from the date of completion of our work.  Any warranties provided by sub-contractors on a project will be passed through to you upon final payment.

7. OTHER

Please see your Client Contract for all terms relating to our services.  In the event of a conflict between the Client Contract and these Terms of Service, the most recent version shall govern, and the more specific shall govern.  Any terms omitted in these Terms of Service but included in the Client Contract shall continue to be binding and have full force and effect.
